These Terms & Conditions (“Terms”) govern participation in classes, programs, events, and related services (collectively, the “Services”) offered by Bulat Training Center LLC (“Bulat Training Center,” “we,” “us,” or “our”). By enrolling yourself or your minor child, and/or by acknowledging these Terms electronically at signup, you agree to be bound by them. If you are the parent or legal guardian of a minor participant, you agree to these Terms both on your own behalf and on the minor’s behalf.
This version supersedes and replaces all prior versions of the same subject matter, whether printed, posted, or electronic.
OVERVIEW (Purpose & Updates)
• We operate a martial arts facility in North Hollywood (City of Los Angeles). Our Services are provided subject to these Terms and any posted studio rules, schedule notices, and policy updates we email or post in-studio.
• We may update these Terms as allowed by California law; material changes will be noticed by email and/or in-studio posting. Your continued participation after the effective date constitutes acceptance.
1) ELIGIBILITY & ONLINE ACKNOWLEDGMENT Initials:
• Age of Majority/Consent - You characterize you are 18 (age of majority in CA) or the parent/guardian of a minor participant with authority to accept these Terms.
• Electronic Agreement - You consent to transact electronically; a paper copy will be provided on request at no charge.
• Minor Authorization - For minors, a parent/guardian must complete and sign the Assumption of Risk/Release section at enrollment. California law allows pre-injury releases for ordinary negligence but not for gross negligence (see Section 13).
2) CONDUCT, HEALTH & FITNESS TO PARTICIPATE Initials:
• Code of Conduct. Respect instructors, staff, and students; follow all safety rules and directions.
• Fitness to Participate. You affirm you (or your minor) are physically fit for martial arts, will disclose relevant medical conditions, and will not attend while ill or contagious.
• Local Rules. You’ll follow posted City of Los Angeles facility rules (occupancy, fire/life safety) while on premises.
3) ASSUMPTION OF RISK, RELEASE & INDEMNITY (CALIFORNIA) Initials:
• Inherent Risks. Martial arts involves physical contact and risks of injury (sprains, strains, concussion, orthopedic injury) and rare but serious harms such as paralysis or even death.
• Assumption of Risk. You (and for a minor, you on their behalf) voluntarily assume all inherent risks of participation.
• Release of Claims. To the maximum extent permitted by California law, you release Bulat Training Center LLC and its personnel from claims arising out of ordinary negligence. This release does not cover gross negligence or willful misconduct, which cannot be waived in California.
• Indemnity. You agree to indemnify and hold us harmless from third-party claims arising from your (or your minor’s) violation of these Terms or misconduct.
• Reference to Standalone Release. The RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT (standalone document) is incorporated by reference and supplements this Section. In case of conflict, California law controls and any broader waiver language is limited to the maximum extent permitted by law.
4) MEMBERSHIPS, TUITION & BILLING Initials:
• 4.1 Month-to-Month Term; Auto-Renewal; Cancel Anytime (End-of-Cycle). All memberships are month-to-month and automatically renew each month unless canceled. You may cancel at any time by (a) emailing admin@btcla.net, (b) giving written notice in-studio, or (c) using the same online channel used to enroll (for online signups). Cancellation is effective at the end of the then-current billing period; access continues through that date.
• 4.2 No Pro-Rated Refunds for Partial Periods (Except Where Required by Law). Upon cancellation of a month-to-month membership, fees for the current billing period are non-refundable and will not be prorated, except where required by California law (including the Health Studio Services Act (HSSA) or other applicable consumer protections such as qualifying medical disability/relocation/closure rights or any cooling-off right that applies).
• 4.3 Health Studio Services Act Disclosures. As a martial arts, we provide HSSA-required disclosures in our membership materials (e.g., clear pricing; start date; statutory cancellation rights for disability, death, or relocation; and any applicable cooling-off language). Copies are available in-studio and by email on request.
• 4.4 Automatic Renewal Law (ARL) Compliance. For recurring plans purchased online, we present clear and conspicuous auto-renewal terms, obtain affirmative consent, send post-purchase acknowledgment with cancellation instructions, and maintain an easy online cancellation method. If you cancel before the next renewal date, auto-renewal stops for the following cycle.
• 4.5 Price Changes; Notice; Your Options. We may change membership prices. Where required by law, we will provide advance notice before a change takes effect. For month-to-month plans, any change will apply to the next billing cycle after the effective date. If you do not agree to a price change, you may cancel before it takes effect. If and to the extent permitted by law, we may implement price changes without prior notice; otherwise, we will provide notice consistent with California’s Automatic Renewal Law.
• 4.6 Differential Pricing; Promotions. We may, at our discretion, offer different prices or promotional rates for the same or similar services (e.g., introductory offers, corporate/teacher/student rates, family plans, time-of-day or capacity-based pricing, or limited-time promotions). Your price does not entitle you to the lowest price offered to others.
• 4.7 Billing Authorization; Late/Declined Payments. You authorize recurring charges to your payment method for tuition, fees, and taxes on the stated schedule. If a payment is late or declined, we may assess a reasonable late fee, attempt re-billing, suspend access, or cancel your membership.
5) CANCELLATIONS, FREEZES & STATUTORY RIGHTS Initials:
• Cooling-Off (If Applicable). Where required by the HSSA, contracts include a right to cancel within a specified window after signing (with instructions on where to send notices and how refunds are handled).
• Medical/Relocation/Closure. HSSA cancellations for disability, death, or material change of facility access will be honored per statute; refunds/credits will be calculated as the law specifies.
• End-of-Cycle Effect; No Proration. When you cancel a month-to-month membership, cancellation is effective at the end of the current billing cycle; access remains available until then. No pro-rated refunds are issued for partial months except where required by law.
• Methods to Cancel. You may cancel by emailing admin@btcla.net, giving written notice in person, or if you enrolled online, via the online cancellation method provided in your account/receipt. We will timestamp your request and email a confirmation.
6) CLASS RESERVATIONS, ATTENDANCE & SCHEDULE CHANGES Initials:
• Reservations/Capacity. Some classes may require advance reservation; waitlists may apply.
• Late Cancel/No-Show. We may charge a reasonable late-cancel/no-show fee if you don’t cancel within the posted window.
• Schedule Adjustments. We may adjust instructors, class times, or formats, and may close for holidays, maintenance, belt testing, tournaments, or emergencies. We’ll communicate changes by email/SMS where possible.
7) UNIFORMS, EQUIPMENT & PERSONAL PROPERTY Initials:
• Required Gear. Approved uniforms and protective gear are required for your program and rank level. Consult with your instructor.
• Property. We are not responsible for lost, stolen, or damaged personal items brought to the studio or off-site events.
8) TESTING, RANK ADVANCEMENT & COMPETITIONS Initials:
• Eligibility - Advancement is based on instructor evaluation, attendance, discipline-specific proficiency, and adherence to our code of conduct. Testing fees may apply.
• Tournaments/Events – Events and tournaments are optional and may require separate registrations/waivers.
• Competition Coaching & Travel Fees - When a coach is required or requested for an external event (e.g., tournament, belt/grading event off-site, seminar), the coach’s fees and reasonable travel-related expenses (e.g., airfare, baggage, hotel, ground transportation, rideshare/taxis, parking, event accreditation/coach passes, and a modest daily per diem) will be pooled and split equally among all Bulat Training Center athletes participating at the same event.
Included expenses:
–Coach’s day rate/on-site coaching time, travel time (as designated by the studio), airfare or mileage, hotel, ground transport, parking/tolls, coach pass/accreditation, and per diem.
Excluded expenses:
- Athlete registration fees, personal travel costs for athletes/families, and non-event leisure activities.
• Deposits & Payment Schedule - A non-refundable deposit (announced with the event signup) is due to secure coaching and booking. The balance is due no later than 7 days before the event (or earlier if required for bookings). Unpaid balances may result in removal from the event roster.
• Cost Sharing Formula - Total eligible coach & travel costs are divided by the number of participating Bulat Training Center athletes requiring coaching at that event. If additional athletes join before final invoicing, each athlete’s share is recalculated downward accordingly.
• Late Withdrawal / No-Show -If an athlete withdraws after non-refundable costs have been incurred (e.g., airline change fees, non-refundable hotel nights, coach pass), that athlete (or parent/guardian) remains responsible for their share of such non-refundable costs and any committed coach time that cannot be mitigated.
• Changes & Overages - If the event schedule changes or runs significantly over (e.g., extended coaching hours or extra hotel nights due to bracket changes), reasonable additional coach time and actual travel overages will be allocated using the same cost-sharing formula and billed after the event with receipts/summary.
• Booking Authority - The studio may coordinate travel and lodging for coaches and, when helpful, suggest hotel blocks for families. Families make their own travel arrangements unless otherwise stated.
• Supervision - Coaches are not guardians/chaperones outside official coaching windows. Parents/guardians are responsible for minor athletes at all other times.
9) SAFETY RULES, FACILITY ACCESS & PROHIBITED CONDUCT Initials:
• Safety First - Follow instructor directions and report hazards/injuries immediately.
• Training Area Access (Mats/Dojo Floor) - To avoid disrupting classes and for safety, no one may enter the training area unless absolutely necessary (e.g., participating students during their class, instructors, or staff responding to safety issues). Spectators must remain in designated viewing areas unless expressly authorized by staff.
• Entry at Own Risk; Implied Assumption/Release for Non-Signers - Anyone who enters the training area (mats/dojo floor) does so at their own risk. By entering the training area or participating in any activity there, even if not formally enrolled, you agree to assume the inherent risks and, to the maximum extent permitted by California law, release Bulat Training Center LLC from claims arising out of ordinary negligence. This does not waive claims for gross negligence, recklessness, or intentional misconduct. We have posted conspicuous notices at the training area entrance stating this rule and referencing our RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT and PARENTAL CONSENT & EMERGENCY TREATMENT FORM.
• Small Children - Small children may not be left unsupervised without an adult. We are not a childcare facility; a parent/guardian must supervise minors who are not actively participating in class and keep them out of the training area.
• Prohibited Conduct - No harassment, discrimination, bullying, dangerous conduct, or possession/use of alcohol, illegal drugs, or smoking/vaping on premises.
• Local Compliance - We follow City of Los Angeles rules on occupancy, signage, noise, and fire/life safety. You must comply with posted house rules while on site.
10) MINORS; PARENT/GUARDIAN RESPONSIBILITIES Initials:
• Drop-Off/Pick-Up. Parents/guardians are responsible for timely drop-off/pick-up and for minors’ behavior outside class time.
• Consent. Parent/guardian must execute the Assumption of Risk/Release for minors
• Incorporated Form. The PARENTAL CONSENT & EMERGENCY TREATMENT FORM is incorporated by reference.
11) PHOTO, VIDEO & LIKENESS (CALIFORNIA RIGHT OF PUBLICITY)
Initials:
• Consent - With enrollment, you grant a royalty-free, worldwide license for us to record classes/events and use images/recordings of you or your minor for training, archives, and reasonable promotional use. For commercial advertising uses in California, we obtain consent consistent with Civil Code §3344 (parent/guardian consent for minors).
• Opt-Out - If you do not consent to promotional use, email admin@btcla.net before attending; we will make reasonable efforts to avoid featured use, though incidental/background capture cannot be guaranteed.
• Reference to Forms. For minors, photo/media consent (or opt-out) may also be captured in the PARENTAL CONSENT & EMERGENCY TREATMENT FORM, incorporated by reference.
12) PRIVACY (CPRA/CCPA) & COMMUNICATIONS (EMAIL/SMS) Initials:
• CPRA/CCPA. Where applicable, California consumers have rights to know/access, delete, correct, and opt-out of “sale” and “sharing” of personal information; we will provide a compliant privacy notice and honor verified requests.
• Children’s Data. We obtain parental consent for data collected from minors under 16 as required in California.
• Operational Messages. You consent to operational email/SMS (schedule updates, closures, billing, emergencies). Marketing SMS requires express written consent and includes clear opt-out instructions; we honor opt-outs. Message/data rates may apply.
13) DISCLAIMER OF WARRANTIES; LIABILITY LIMITS (CALIFORNIA)
Initials:
• “As Is” Services - Classes and programs are provided “as is” and “as available.”
• Waiver Scope (California) - Pre-injury waivers can cover ordinary negligence but not gross negligence/willful misconduct; any waiver language is construed narrowly under CA law. Our limitation of liability applies only to the extent permitted by California law.
• Cap on Damages - To the maximum extent allowed, our total liability is limited to the tuition paid in the preceding three (3) months before the claim, excluding claims that cannot be limited by law.
14) USER CONTENT & FEEDBACK Initials:
• If you submit reviews, testimonials, or suggestions, you grant us a non-exclusive license to use them for training or marketing (with or without attribution). We will not disclose sensitive personal information in marketing without separate consent as required by California privacy law.
15) GENERAL CONDITIONS; RIGHT TO REFUSE SERVICE Initials:
• We reserve the right to refuse or discontinue service to anyone for any lawful, non-discriminatory reason, including safety or policy violations. We do not refuse service on the basis of any protected characteristic under applicable civil rights laws.
16) CHANGES TO TERMS, PRICES & POLICIES Initials:
• We may update Terms, policies, schedules, and prices without advance notice, to the extent permitted by law. For recurring memberships, we will comply with California’s Automatic Renewal Law regarding clear notice of material changes and an easy cancellation path; you may cancel if you don’t agree to changes before they take effect.
17) SUSPENSION & TERMINATION Initials:
• We may suspend or terminate participation for nonpayment, safety violations, or repeated misconduct. You remain responsible for fees through the effective termination date (subject to HSSA/ARL rights).
18) SEVERABILITY & NO WAIVER Initials:
• If any provision is unlawful or unenforceable, the remainder remains in effect. Our failure to enforce a provision isn’t a waiver.
19) GOVERNING LAW; VENUE Initials:
• These Terms are governed by the laws of the State of California with venue in Los Angeles County, California.
20) DISPUTE RESOLUTION Initials:
• Good-Faith Resolution. Before filing a claim, the parties will try to resolve disputes informally within 30 days after written notice.
• Arbitration (Optional Clause). If included, disputes will be resolved under a consumer-friendly process (e.g., AAA Consumer Rules) in Los Angeles County, with remedies available as in court and fees allocated per the rules. If you prefer not to use arbitration, delete this section.
21) INCORPORATED FORMS & ENTIRE AGREEMENT Initials:
• Incorporated by Reference. The following documents are incorporated by reference and made part of these Terms: (i) RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, and (ii) PARENTAL CONSENT & EMERGENCY TREATMENT FORM (for minor participants).
• Entire Agreement. These Terms (plus if any posted rules and if any policy addenda provided at signup) constitute the entire agreement and supersede prior understandings.

PLEASE READ CAREFULLY. BY INITIALING EACH BOX AND SIGNING BELOW,
YOU ARE WAIVING IMPORTANT LEGAL RIGHTS.
This Release of Liability and Assumption of Risk Agreement (the “Release”) is entered into by the undersigned Participant and/or Parent/Guardian of a minor Participant (collectively, “I,” “me,” or “my”), in favor of Bulat Training Center, LLC, a California limited liability company (the “Company”), its owners, officers, directors, employees, agents, affiliates, and volunteers (collectively, the “Releasees”).
1. ACTIVITIES COVERED
This Release applies to all activities, programs, training, classes, events, use of equipment, and use of premises provided or sponsored by the Company (the “Activities”), including but not limited to exercise, martial arts, personal training, competitions, open gym, and related events.
2. ASSUMPTION OF RISK Initials:
I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES ARE POTENTIALLY DANGEROUS AND INVOLVE THE RISK OF SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT SUCH RISKS MAY ARISE FROM, AMONG OTHER THINGS, (A) FALLS, COLLISIONS, OR OVEREXERTION; (B) EQUIPMENT FAILURE OR MISUSE; (C) THE ACTIONS OR INACTIONS OF OTHER PARTICIPANTS OR STAFF; AND (D) EXPOSURE TO COMMUNICABLE DISEASES. I VOLUNTARILY PARTICIPATE IN THE ACTIVITIES WITH FULL KNOWLEDGE AND ACCEPTANCE OF THESE RISKS.
3. RELEASE OF LIABILITY Initials:
TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, I RELEASE AND DISCHARGE THE COMPANY AND RELEASEES FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING OUT OF OR ATTRIBUTABLE TO THE ORDINARY NEGLIGENCE OF THE COMPANY OR RELEASEES IN CONNECTION WITH THE ACTIVITIES. THIS RELEASE DOES NOT APPLY TO CLAIMS RESULTING FROM GROSS NEGLIGENCE, RECKLESS, OR INTENTIONAL MISCONDUCT.
4. WAIVER OF UNKNOWN CLAIMS (CAL. CIV. CODE § 1542) Initials:
I UNDERSTAND AND AGREE THAT THIS RELEASE EXTENDS TO CLAIMS I DO NOT KNOW OR SUSPECT TO EXIST AT THE TIME OF SIGNING. I HEREBY EXPRESSLY WAIVE ALL RIGHTS, BENEFITS, AND PROTECTIONS I MAY HAVE UNDER CALIFORNIA CIVIL CODE § 1542, WHICH STATES:
"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
5. INDEMNITY Initials:
I AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE COMPANY AND RELEASEES FROM ANY THIRD-PARTY CLAIMS, DAMAGES, OR LIABILITIES TO THE EXTENT CAUSED BY MY ACTS, OMISSIONS, OR FAILURE TO FOLLOW SAFETY RULES. THIS INDEMNITY DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESS, OR INTENTIONAL MISCONDUCT OF THE COMPANY.
6. HEALTH & RULES Initials:
I represent that I am physically fit to participate in the Activities, have no undisclosed medical condition that would endanger me, and agree to follow all rules, instructions, and safety guidance.
7. EMERGENCY MEDICAL CONSENT Initials:
I consent to receive medical treatment deemed necessary in the event of injury during the Activities. I agree that I am solely responsible for all associated costs.
8. GOVERNING LAW & VENUE Initials:
This Release is governed by California law. Any claim arising under this Release shall
be brought exclusively in the state courts of Los Angeles County, California.
